Intellectual property

1. All content on the Site, including text, graphics, logos, images, audio, video, software, and the overall design and arrangement, is owned by or licensed to Biogenomics and is protected by copyright, trademark, and other intellectual property laws.

2. Defaming, harassing, abusing, threatening, or otherwise harming Biogenomics, its employees, or any other person.
3. Uploading, transmitting, or distributing any viruses, malware, or other harmful code that could damage or interfere with the operation of the Site or any systems.
4. Attempting to gain unauthorized access to the Site, other user accounts, or any computer systems or networks connected to the Site.
5. Posting or transmitting any material that is unlawful, harmful, fraudulent, defamatory, obscene, hateful, racist, sexually explicit, or otherwise objectionable, or that may damage Biogenomics’ reputation or the security of the Site.
6. Using any automated means (such as bots, crawlers, or scrapers) to access, monitor, or copy the Site or its content without our prior written permission, except for standard indexing by search engines.

We may, in our sole discretion, suspend or terminate your access to the Site if you engage in any prohibited conduct.

Warranties and disclaimers

   • The Site or any content will be accurate, complete, reliable, current, or error‑free.
   • The Site will be available at any particular time or location, uninterrupted, secure, or free of viruses or other harmful components.
   • Any defects or errors will be corrected.
4. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you to the extent prohibited by law.

Limitation of liability

To the maximum extent permitted by law, Biogenomics and its officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of or inability to use the Site, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.

To the extent permitted by law, Biogenomics’ total cumulative liability for any and all claims arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars (USD $100) or the amount you paid to us (if any) for use of the Site during the twelve (12) months prior to the event giving rise to the claim, whichever is greater.
3. Some jurisdictions do not allow limitations on certain types of damages, so some of the above limitations may not apply to you to the extent prohibited by law.

Suspension and termination

1. We may, at any time and without notice, suspend, restrict, or terminate your access to all or part of the Site if we believe:
   • You have violated these Terms or any applicable law; or
   • Your use of the Site could create risk or harm for us, the Site, or other users.

Governing law and jurisdiction

1. These Terms and any dispute arising out of or relating to the Site or your use of it are governed by the laws of the United States of America and the State of Nevada, without regard to its conflict‑of‑law rules.
2. You and Biogenomics agree that any legal action or proceeding arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Nevada, United States of America, and you consent to the personal jurisdiction and venue of those courts.

Changes to these Terms

1. We may update these Terms from time to time. When we do, we will revise the “Effective date” at the top of this page.
2. Changes take effect when we post the updated Terms on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.
